Privacy Policy
Last updated: November 3, 2026
This privacy policy describes how I collect and use the personal information you provide on my website. By accessing and using my website, you indicate your agreement to this privacy policy.
Please read these terms carefully. For online classes, please also review my Terms of Service.
Data Controller
The data controller is Marina Teding van Berkhout. For privacy questions or requests, contact marinatvbart@marinatvb.com.
Information I Collect
I collect information from you when you subscribe to my email list to receive news and be informed of my classes, when you register for a course, respond to a survey or fill out a form (contact form, payment plan request, etc.).
When subscribing or registering, you may be asked, as appropriate, your first and last name, your email address, your mailing address, your preferred language and your credit card information.
Like most website operators, I collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference and the referring site. I use this type of information to administer the site and provide the highest possible level of service to you.
For the two timed free flower classes, I record the first time each lesson page is opened so I can understand whether students are able to start and progress through the class. These records use only internal enrollment and lesson identifiers. I do not store an email address, IP address, device details, referring page, access token or cookie value in the lesson-open record, and the information is shown only as combined totals in my private administration area.
The Use of Your Information
I use the information you provide:
- to communicate with you about Marina Teding van Berkhout’s art and online classes,
- to improve my products, services and website,
- to process transactions.
Legal Bases for Processing
I process your information based on your consent (for newsletters and marketing), to perform a contract (to provide classes, digital products, or services you purchase), to comply with legal obligations (for example, accounting records), and for legitimate interests such as site security and service improvement.
Information Sharing
I do share your information with trusted third parties who assist me in operating my website, conducting my business and servicing students and visitors, such as my payment processors (PayPal and Stripe), my email service provider, etc. These trusted third parties agree to keep this information confidential. I will never share your personal information with unrelated third parties.
I don’t store your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their own privacy policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.
I will never sell or give away the information I collect to anyone other than to satisfy any applicable law, regulation, legal process or governmental request, as required by law.
International Transfers
Some of my service providers may process data outside the European Economic Area. Where this occurs, I rely on appropriate safeguards such as standard contractual clauses or other lawful transfer mechanisms.
Cookies
Cookies are small pieces of text sent to your browser when you visit a site. They serve a variety of functions, like enabling us to remember certain information you provide to me as you navigate between pages on the website. If you do not wish to have cookies placed on your computer, you should set your browser to refuse cookies. Certain features of my website, especially classes access, may not function properly without the aid of cookies.
From November 3, 2026, Google Analytics and Meta Pixel load automatically on eligible public pages when there is no saved refusal. They measure page visits, public content popularity, and signup or purchase events. An absent preference is not recorded as your consent. Private account and classroom pages and sensitive access links are excluded. You can turn measurement off with “Cookie choices” in the footer. The site remembers an explicit choice in a preference cookie. A saved refusal is respected: those tools are not loaded, the website and free classes still work, and no traffic-source history is saved.
A Meta advertisement may add its own opaque click identifier to the landing-page address. When measurement is enabled, Meta Pixel may use that identifier to attribute the visit and a later signup to the advertisement. The identifier may be kept in Meta’s _fbc cookie for up to 90 days to preserve the ad click across the signup and welcome pages. It is not copied into signup form data, Stripe metadata, or enrollment records. Like other first-party cookies, it accompanies requests to this website.
For eligible new free flower-class signups, the website can report a Lead directly to Meta using its Conversions API. This makes delivery independent of the browser script. A saved refusal also disables this server reporting. An absent preference follows the public measurement policy above and is not recorded as consent. The report contains the public class address, signup time, a random conversion ID, a SHA-256 hash of the signup email, the browser user agent and, when available, Meta’s existing _fbp and _fbc cookie values. It contains no plain-text email, name, private class link or access token. Repeat class access does not create another Lead. Browser and server Lead reporting are not used together for the same new enrollment.
Pending server reports expire after 24 hours. Matching information is removed on the next cleanup run, normally within five minutes, or sooner after recorded acceptance, a terminal failure or cancellation. Limited delivery status is scheduled for deletion after 30 days. Service outages can delay cleanup. Choosing “Only necessary cookies” cancels pending reports associated with this browser’s verified class access; a report already being transmitted cannot be recalled by that choice. You can contact me to exercise your rights.
When measurement is enabled, the site may keep an allowlisted first and latest traffic source in browser local storage for a rolling period of up to 90 days. This can include a broad source and medium and a fixed campaign or content label. It does not keep raw referring URLs, search terms, advertising click IDs, access tokens, or email addresses in that browser record. When you sign up for one of the two free flower classes or purchase its lifetime-access offer, that limited source snapshot may be copied to the associated enrollment or purchase record so I can connect a campaign to signups and paid purchases.
Children
I do not knowingly collect any information from anyone under 16 years of age. No personally-identifiable information should be given by visitors under 16 years of age without the prior written consent of their parent or guardian.
Your Rights
Depending on your location, you may have rights to access, rectify, erase, restrict, or object to processing, and to data portability. You may also withdraw consent at any time. To exercise these rights, contact marinatvbart@marinatvb.com. You also have the right to lodge a complaint with your local supervisory authority, such as the CNIL in France.
Security
To protect your personal information, I take reasonable precautions and follow industry best practices to make sure it is safely kept.
But no Internet data exchange can be guaranteed to be fully secure. While I make every effort to protect your personal information, you acknowledge that the personal information you voluntarily share with me could be accessed by a third-party. You agree that I am not responsible for any intercepted information shared through my site without my knowledge or permission. Additionally, you release me from any and all claims arising out of or related to the use of such intercepted information in any unauthorized manner.
Website Links
My website contains links to third-party websites and plug-ins (including Pinterest, YouTube, Vimeo, Facebook and Instagram). When data is collected in this way, its processing is governed by the privacy policy of the respective social media platforms.
Your Images
You give permission to Marina Teding van Berkhout to use any images you submit as a participant in my online classes, whether on the classroom site, by email or in the Facebook group, to be used in any future class-related marketing or promotional strategies, online or offline. You will always be credited and will retain the rights to your work. If you want your images removed, please contact me at marinatvbart@marinatvb.com.
Unsubscribe
You can unsubscribe at any time by clicking the “unsubscribe” button at the bottom of my emails or by contacting me at marinatvbart@marinatvb.com.
Data Retention
I will retain your information for as long as you wish to be registered to my mailing list and as long as your customer account is active and you have not otherwise requested me to delete your information.
If you’ve registered for one of my classes, I’ll keep transaction and accounting records for at least 10 years in accordance with French law.
Free flower-class lesson-open records are deleted automatically if their associated enrollment or lesson is deleted.
The 90-day period above applies only to browser storage. It does not automatically delete a source snapshot copied to an enrollment or purchase record, or limited attribution metadata passed to Stripe. A specific retention period and consent-withdrawal deletion process for those server-side and Stripe records must be approved before this measurement feature is activated. You may contact me to exercise the privacy rights described above.
Privacy Policy Changes
I reserve the right, at my sole discretion, to update my privacy policy, in particular to be in conformity with the law. I encourage you to periodically review my terms to stay informed of my updates.
Information in these conditions is governed by the laws of the Republic of France. Any dispute arising from the use of information or services provided on www.marinatvb.com will be governed by the laws of France.
